Originalism: What Does it Mean Today and Likely to Mean in the Future?

Join the Milwaukee Lawyers Chapter for a Constitution Day luncheon and panel exploring the past, present, and future of originalism.

It’s been said that originalism has developed in three stages. During the first stage, early originalists like Judge Bork and Raoul Berger looked to the intent of the drafters. Then, in stage two, originalists like Justice Scalia turned their focus to ascertaining the intent of the ratifiers. This became known as original public meaning originalism. Now, some have posited that we have entered a third stage, where originalists focus on text, history, and tradition in an effort to decipher the original understanding of legal texts.

In this Constitution Day panel, hosted by the Milwaukee Lawyers Chapter of the Federalist Society, esteemed originalists will explore what originalism means today and what the future of originalism may hold. Panelists will include Justice Brian Hagedorn of the Wisconsin Supreme Court, former United States Attorney Steven Biskupic, and former law clerk to both Justices Scalia and Kavanaugh, Rebecca Taibleson. The panel will be moderated by Alex Lemke.
