Legislating the War on Terror

The War on Terror is being waged within a legal framework that is ever changing and ill-defined. Although the courts have increasingly taken an active role in shaping that framework, Congress has been comparatively silent. A number of commentators have argued that Congress should be taking a greater role in defining that framework, particularly in setting forth clear rules for existing habeas corpus litigation following Boumediene v. Bush. What is the proper role of each branch of government? Would legislation lead to more coherent policy? By which branch can national security, civil liberties, and the rule of law all be best preserved? Our panel of experts will discuss these and other issues.
