Hobby Lobby and Religious Freedom: Assessing the Supreme Court’s Decision

• Kyle Duncan: Lead Counsel for Hobby Lobby Stores in its HHS Mandate Challenge; Former General Counsel, The Becket Fund for Religious Liberty

The U.S. Supreme Court’s decision in Burwell v. Hobby Lobby Stores, Inc. earlier this year generated a great deal of debate on the national stage. Supporters of Hobby Lobby argue that the Court’s decision protects religious liberty and properly interprets the Religious Freedom Restoration Act, while detractors argue that the Court greatly expanded the scope of the Religious Freedom Restoration Act and created a dangerous precedent. Frequent appellate litigator Kyle Duncan, formerly the general counsel of The Becket Fund for Religious Liberty and also the former Solicitor General of the State of Louisiana, was lead counsel for Hobby Lobby Stores in its challenge to the “HHS mandate.” Mr. Duncan will discuss his involvement in the case, the Supreme Court’s decision, and the likely impact of that decision in the years to come.
