Amidst the acrimony following controversial Supreme Court decisions and seemingly intractable debate between Originalists, Living Constitutionalists, Minimalists and the rest, it is easy to despair. Can courts be objective? Can they get the law right?
Yes. Based on her book Judicial Review in an Objective Legal System (Cambridge University Press, 2015), Smith will explain how. By puncturing the mystique of objectivity and showing it to be a demanding yet “doable” discipline, she will draw from the basic character of a proper legal system to chart the essentials of objectivity in judicial review.

Tara Smith is a professor of philosophy at University of Texas at Austin, where she holds the BB&T Chair for the Study of Objectivism. A specialist in moral, political, and legal philosophy, Smith has published widely on subjects ranging from rights conflicts to forgiveness, pride and perfection to the value of sport. Her three previous books concern individual rights, the foundations of value, and egoistic virtues.
