On January 21, 2010, the Supreme Court released its decision in Citizens United v. Federal Election Commission, in which the Court struck down a provision of the McCain-Feingold that prohibited corporations and unions from directly paying for "electioneering communications" within 30 days of a federal primary election. The decision has important implications for campaign finance; moreover, Justice Stevens' dissent has raised important questions about corporate "personhood" (i.e. the extent to which corporations may enjoy the same rights as natural persons). Professor Smith will discuss the Citizens United case and how it will affect campaign finance jurisprudence, free speech rights, and the impact of the debate over corporate "personhood" raised in the case.
