Early in his term, President Trump signed an executive order that interpreted the Fourteenth Amendment to not confer birthright citizenship on children born in the United States to parents unlawfully in the United States or lawful but temporary. The order was enjoined by lower courts and the U.S. Supreme Court is considering appeals from those injunctions. John Eastman will break down the constitutional arguments concerning the interpretation and application of the Fourteenth Amendment’s citizenship clause.
