State Attorneys General -- from Mike Moore taking on Big Tobacco and Eliot Spitzer battling Wall Street, to Jim Hood targeting the Insurance Industry -- often acting in concert with trial lawyers and special interest groups, have put a bulls-eye on American industry and business sectors, and through novel and aggressive multi-state lawsuits, have engaged in a form of activism which seems contrary to both federalism and democratic principles. The Federalist Society of Mississippi will explore the perhaps unintended role of State Attorneys General as law makers versus law enforcers.
