Qualified immunity, the Supreme Court-created doctrine shielding government officials from liability if they do not violate “clearly established” rights, has come under increasing attack from both the left and right, especially in the Fifth Circuit. How did the doctrine find its way into constitutional law without an originalist basis? Will abolishing qualified immunity make things worse? Are there reforms at the margin that can curb the worst problems with qualified immunity?
Ted Frank is the director of litigation at the Hamilton Lincoln Law Institute, a conservative public interest law firm. He’s argued in the Supreme Court and in most of the federal courts of appeals, winning landmark cases in class action law.
