The Supreme Court granted Certiorari to determine whether Microsoft, a critic of the current patent validity presumption is correct, in that it gives power to shake down large players for baseless settlements or to even scare them out of markets entirely. Patent defenders say the presumption is the key to a patent's value. Some offer a third way under which the presumption of validity is dialed down but the ability for both patentees and infringers to collect attorneys' fees and enhanced damages whenever their opponents make baseless arguments is made easier. This panel will explore these and other key issues the case raises about the patent system in general.
