Description

Over the last decade, the makeup of the federal judiciary has shifted, with many originalists and others with a philosophy of judicial conservatism confirmed to the federal bench. This transformation included the confirmation of three originalists to the United States Supreme Court, which led to monumental decisions in the Dobbs, Chevron, and SFFA cases, among many others. Our panel will discuss this transformation, beginning with Senator McConnell’s decision to hold the “Scalia” seat open on the Court in 2016. Panelists will also discuss the invocation of the “nuclear option” to allow judicial nominees to be confirmed by a simple majority vote and the decision to end the use of blue slips for appellate nominees. They will also consider how stare decisis and precedent is viewed by the current Court; how debates on history, text, and tradition are currently generating debate among originalists judges; and how judicial appointments might look like in future presidential administrations.

Description

In its last term, the United States Supreme Court engaged in a monumental rewrite of administrative law. From Loper Bright v. Raimondo, to SEC vs. Jarkesy, to Corner Post, and others–the Supreme Court emphatically reasserted the judiciary’s role in saying what the law is. This panel will review those holdings, discuss what’s next, will preview upcoming litigation in the courts and explore the future of administrative action and the role of the courts.

Description

On its face, the corporate governance theory known as ESG (environmental, social and governance) is an approach that implements environmental programs, such as limiting carbon emissions, substantiality, equity and diversity, and other similar considerations as an alternative to traditional philosophies of corporate governance. ESG positions itself as the ethical or socially responsible alternative to corporate governance. Likewise, regulators such as the SEC, EPA, and Labor have imposed various reporting and other requirements to monitor, encourage and require the corporation’s compliance with ESG. This panel examines the underpinnings of ESG and whether it is a force for social change instead of corporate governance, whether corporations can and do have fidelity to its investors under ESG, and the viability of ESG Supreme Court decisions that limit the authority of the administrative state.
