On April 16, 2008, the Supreme Court heard oral argument in Taylor v. Sturgell. At issue in the case is whether a FOIA request may be barred by res judicata on grounds the petitioner was "virtually represented" by a close associate who previously sought disclosure of the same documents. Vanderbilt University Law School Professor Richard Nagareda discusses the case.
