The 2nd Circuit has temporarily blocked the SEC’s prosecution of Lynn Tilton, a financier accused of defrauding investors by overstating the performance of some of her firm’s assets. The New York Times reports that “Tilton had objected to the SEC’s effort to try her in an in-house administrative proceeding, rather than in federal court.” The use of administrative law judges within administrative agencies will be the topic of the panel on which I’m serving at this year’s National Lawyers Convention in November.
