Abby joined FIRE after her tenure at the Becket Fund for Religious Liberty, where she litigated First Amendment student group cases from coast to coast. She also worked at a trial litigation boutique in southern California. Abby has filed briefs on the First Amendment in state and federal court at the trial and appellate court levels, including before the U.S. Supreme Court.
Abby received her B.S. in economics and her B.A. in Chinese language and literature from the University of Pittsburgh, where she graduated summa cum laude. During college, she also spent a year at Tsinghua University as a Boren Fellow. She later received her J.D. from the University of Chicago Law School, where she won the 2018 Hinton Moot Court Competition. After law school, Abby clerked for the Honorable Michael B. Brennan on the Seventh Circuit Court of Appeals in Milwaukee, Wisconsin. She is admitted to practice in New York and California, as well as several federal appellate courts and the U.S. Supreme Court.
Abby lives outside Dallas, Texas, with her husband and family. They enjoy reading together, volunteering with their local church, and continuing to fix their leaky pool.
Partner, Lewis Brisbois
Sarah E. Lang is a partner in the New York office of Lewis Brisbois and a member of the Appellate Practice. Ms. Lang has represented clients at all levels of state and federal courts, including the New York State Appellate Division, the Second Circuit Court of Appeals, and the U.S. Supreme Court. The primary focus of her practice is drafting and arguing substantive motions and appeals before the federal courts and New York’s trial and appellate courts in substantive areas including general liability, New York Labor Law, medical malpractice, premises liability, and rideshare and transportation matters, among others. She also has extensive experience representing clients, including religious institutions, in matters arising under Title VII, the First Amendment, RLUIPA, New York’s City and State Human Rights Laws, New York’s Religious Corporations Law, and New York’s Real Property Tax Law. This includes federal jury trial experience and providing preventive advice and counseling. Prior to joining the firm, Ms. Lang clerked on the United States Court of Appeals for the Eighth Circuit, as well as the United States District Court for the Eastern District of North Carolina. She also previously served as an Attorney Advisor for the United States Department of Education.
Tammy McCutchen is a leading authority on federal and state wage-hour laws and prevailing wage laws. She counsels businesses on wage-hour compliance, including conducting internal audits on independent contractor status, overtime exemptions, and other pay practices. She also represents employers during investigations by the U.S. Department of Labor and serves as an expert witness in wage-hour class actions. She was a founding officer of ComplianceHR, a law and technology company, where she created AI-based applications to evaluate independent contractor and overtime exempt status.
Ms. McCutchen served as Administrator of the U.S. Department of Labor’s Wage and Hour Division, appointed by President Bush and confirmed by the Senate in 2001. She was the primary architect of the 2004 revisions to the overtime exemption regulations, the first major changes to the regulations in 55 years.
Before joining DOL, she was senior counsel for the Hershey Company in Hershey, Pennsylvania.
Ms. McCutchen has been a volunteer leader of the Federalist Society since 1989. She served in leadership roles for the Northwestern Student Chapter and Chicago Lawyers Chapter. She currently serves in leadership for the Labor & Employment Practice Group, the Regulatory Transparency Project, and the Knoxville, TN Lawyers Chapter. She served on the Editorial Advisory Board of Law360, the Labor Committee of the U.S. Chamber of Commerce, the Small Business Legal Advisory Board of the National Federation of Independent Business, and a Policy Fellow at the ACU Foundation.

Rachel N. Morrison is an attorney and Fellow at the Ethics and Public Policy Center, where she directs EPPC’s Administrative State Accountability Project. Her legal and policy work focuses on religious liberty, health care rights of conscience, the right to life, nondiscrimination, and civil rights.
Before joining EPPC, Ms. Morrison served as an Attorney Advisor and Special Assistant to General Counsel Sharon Fast Gustafson at the Equal Employment Opportunity Commission (EEOC), where she focused on religious discrimination issues and was a member of the General Counsel’s Religious Discrimination Work Group. Before that, she served as Litigation Counsel for Americans United for Life and as a Constitutional Law Fellow at the Becket Fund for Religious Liberty, defending the right to life and religious freedom for all. She also clerked on the U.S. Court of Federal Claims.
Ms. Morrison’s legal analysis has been published in the Seton Hall Law Review, the Pepperdine Law Review, and the Ave Maria Law Review, as well as various other print media outlets.
Ms. Morrison earned her J.D., magna cum laude, from the Pepperdine University School of Law, where she was elected to the Order of the Coif and served as an editor for the Pepperdine Law Review and the Harvard Journal of Law & Public Policy. She received her B.A. in Mathematics and Speech Communication, summa cum laude, from Whitworth University (Spokane, WA). She is a member of the District of Columbia and the Washington State bars.

John G. Malcolm oversees Advancing American Freedom’s work to increase understanding of the Constitution and the rule of law as Vice President of the organization’s Edwin Meese III Institute for the Rule of Law. Malcolm brings to the challenge a wealth of legal expertise and experience in both the public and private sectors.
Prior to joining Advancing American Freedom in 2025, Malcolm was the Vice President of the Institute for Constitutional Government and the Director of the Meese Center for Legal and Judicial Studies at the Heritage Foundation. Prior to joining Heritage in 2012, Malcolm was general counsel at the U.S. Commission on International Religious Freedom, as well as a distinguished practitioner in residence at Pepperdine Law School. From 2004 to 2009, Malcolm was executive vice president and director of worldwide anti-piracy operations for the Motion Picture Association.
Malcolm served as a deputy assistant attorney general in the Department of Justice’s Criminal Division from 2001 to 2004, where he oversaw sections on computer crime and intellectual property, domestic security, child exploitation and obscenity, and special investigations. Immediately prior to that, he was a founding partner in the Atlanta law firm of Malcolm & Schroeder, LLP.
From 1990 to 1997, Malcolm was an assistant U.S. attorney in Atlanta, assigned to the fraud and public corruption section, and also an associate independent counsel, investigating fraud and abuse in the Department of Housing and Urban Development. He was honored with the Director’s Award for Superior Performance for his work in connection with the successful prosecution of Walter Leroy Moody Jr., who assassinated an 11th Circuit judge and the head of the Savannah chapter of the NAACP.
A graduate of Harvard Law School and Columbia College, Malcolm began his career as a law clerk to a federal district court judge and a federal appellate court judge, and as an associate at the Atlanta-based law firm of Sutherland, Asbill & Brennan (new Eversheds Sutherland).
Malcolm, who resides in Washington, D.C., serves on the Board of Trustees of the Washington National Opera and is a Senate-confirmed member of the Board of Directors of the Legal Services Corporation, the largest funder of civil legal aid in the United States.

John Raudabaugh is a labor lawyer and former Member of the U.S. National Labor Relations Board. He was a partner in law firms representing management concerning domestic and international labor law matters. Currently, he represents employees seeking relief from union and/or employer unfair labor practices. Mr. Raudabaugh has presented testimony to both Senate and House Committees regarding labor law reform. Professor Raudabaugh teaches Labor Law and a Labor Law Practicum at the Ave Maria School of Law. Earlier in his career, he was an equity partner at Holland & Hart LLP, where he chaired the firm’s nationwide religious institutions and First Amendment practice group and was a member of the firm's complex civil litigation and employment practice groups. He also taught religious liberty law at the University of Denver Sturm College of Law and clerked for Chief Judge Timothy M. Tymkovich of the United States Court of Appeals for the Tenth Circuit.
Steven graduated magna cum laude from the University of Michigan Law School, where he was elected to the Order of the Coif and served as an editor on The Michigan Law Review and The Michigan Journal of Race and Law.
