Although this panel is entitled “Are We Over-Lawyering in International Affairs?,” I think the better way to describe it is: What is the role of lawyers in making legal policy? As you’ve heard from several of the panel discussions at this Convention, the global war on terror has raised not only serious and difficult legal questions but serious and difficult legal policy issues, such as whether terrorism should be addressed as a matter of criminal law or a matter of the laws of war, and whether it presents a new paradigm that must be addressed by a new set of rules, and what should those rules be....
