Does the power of judicial review imply that the Supreme Court can amend the Constitution?
Professor Ilan Wurman discusses how a written Constitution is superior to all branches of the government, including the judicial branch. The power of judicial review is a power to interpret and apply the laws as written, but not a power to change the meaning of the laws.
Ilan Wurman is a visiting assistant professor at the Sandra Day O'Connor College of Law at Arizona State University, where he teaches administrative law and constitutional law. He is the author of A Debt Against the Living: An Introduction to Originalism (Cambridge 2017).
