The Separation of Powers and the non-Unitary Executive in Kentucky: An Update

Central Kentucky Lawyers Chapter

Serafini
243 W Broadway St.
Frankfort, KY 40601

Please join the Central Kentucky Lawyers Chapter for a luncheon and discussion about the Kentucky Constitution.

In their opinions, Kentucky courts like to use the oft-repeated adage that the Commonwealth has the strongest separation of powers doctrine in the country. But is that really the case? Kentucky also has a non-unitary executive, with five other statewide constitutional officers being elected independently of the Governor. How does the non-unitary executive relate to the separation of powers? Aaron Silletto, Executive Director of the Attorney General's Office of Civil and Environmental Law, will review the principal separation-of-powers and non-unitary-executive cases and recent developments in this area, and discuss the course ahead for the Supreme Court of Kentucky.
