The Ninth Amendment to the United States Constitution provides that "[t]he enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." The proper interpretation of this amendment has been much debated both in the courts and in the academy. Our speaker, Professor Kurt T. Lash, has published several law review articles on the history and theory of the Ninth, Tenth, and Eleventh Amendments. In his recently-published book "The Lost History of the Ninth Amendment," Professor Lash presents newly discovered evidence that the Ninth Amendment was originally understood as working alongside the Tenth Amendment to limit federal power and preserve the people's right to local selfgovernment. Professor Lash will discuss his book and the general issue of constitutional federalism.
