The Ohio Supreme Court’s recent decision in State ex rel. Cincinnati Enquirer v. Bloom has renewed debate about the strength and potential of judicial federalism in Ohio. In Bloom, the Ohio Supreme Court restated its commitment to review the Ohio Constitution independent of how federal courts treat similar provisions in the U.S. Constitution and to provide limited stare decisis effect to prior decisions that “lockstepped” the Ohio Constitution to the U.S. Constitution without analysis. Our speaker, Judge Matthew Hebebrand, will examine the “open courts” and “right to remedy” provisions in Article I, Section 16 of Ohio’s Constitution and how Bloom may lead to independent development of these state constitutional guarantees.
