Under a mandate promulgated by the Department of Health and Human Services pursuant to the Affordable Care Act, religious institutions, including schools, charities and hospitals, are required to purchase abortion-producing drugs and sterilization coverage for their employees. In response, eighty-seven plaintiffs have filed twenty-seven lawsuits challenging the constitutionality and lawfulness of the mandate under the Religious Freedom Restoration Act. Three of these cases are pending in the United States District Court for the Western District of Pennsylvania.

John S. Baker is the Distinguished Scholar in Residence at the Catholic University School of Law and Professor Emeritus at Louisiana State University Law Center where he taught constitutional law.
