New Legal Tools to Combat Emerging Foreign Threats

After the terrorist attacks of 9/11, the United States government developed and greatly expanded its national security powers and authorities to target terrorist groups like al Qaeda and then ISIS.  But today the United States faces a “new” national security threat from countries like China, Russia, and Iran.  In this Great Power Competition, the United States cannot rely on those same tools like drone strikes, Special Forces, or counter-terrorism prosecutions, but we can learn some of the lessons from those successes as the United States starts to rely on “new” and updated national security tools like economic sanctions, export controls, and investment controls to protect and defend the United States.  Carter Burwell is a former counter-terrorism prosecutor at the Department of Justice who worked on the Senate Judiciary Committee before joining the Treasury Department and discusses the use of new national security tools to face new national security threats.
