Description

In 2026, the United States will mark the 250th anniversary of the Declaration of Independence. This special panel is part of the Federalist Society’s American History & Tradition Project which seeks to celebrate our founding principles, defend the Constitution, and restore serious public engagement with America’s history and civic identity. This panel will explore what the Declaration of Independence means to members of the judiciary in a historical and contemporary context. Think of the contrast between Hadley Arkes’s natural law approach and originalism, Justice Thomas’s interpretive framework; the fact that the Declaration is actually incorporated into the U.S. Code. More broadly, this panel will explore how, like the Constitution, the Declaration can serve as a foundation for big-picture legal discussions on the rule of law, separation of powers, or the administrative state

Featuring:

  • Hon. Sarah Keeton Campbell, Justice, Tennessee Supreme Court
  • Hon. Matthew Kacsmaryk, Judge, U.S. District Court, Northern District of Texas
  • Hon. David Stras, Judge, U.S Court of Appeals, Eighth Circuit
