America's judicial system is a dispute resolution mechanism that primarily relies on adversaries to present evidence and make argument. Judges discern the truth from this clash of adversaries. But what of the belief that a judge owes a duty to the public and the parties to make the right decision, no matter what the parties advocate? That is, that the court ought to conduct an independent search for the truth. When may or should a judge decide cases based on sua sponte determinations of law or fact? What happens if a judge sees an argument the parties missed? This presentation and discussion will focus on the historical and present-day role of the judge as "truth seeker"
