Independent Agencies and the OIRA Review Process

The question of agency independence is front and center in modern political and legal discourse—the subject of both high-profile executive action and a major pending case in the U.S. Supreme Court. Much of the focus centers on whether the President can remove independent agency heads, but another issue is becoming increasingly relevant: the extent to which these agencies are subject to OIRA review. The White House Office of Information and Regulatory Affairs (“OIRA”) is a central clearinghouse for executive branch regulatory activity, and President Donald Trump’s administration has sought to require purportedly independent agencies to comply with OIRA review. A panel of expert discussants will shine some light on the current (and future) relationship between OIRA and the independent agencies.
