The difference between the confirmation hearings for Robert Bork in 1987 and Neil Gorsuch in 2017 was dramatic. Much has changed over the past 30 years. In this talk, Professor Barnett explains how the efforts of a handful of legal academics developed and improved Oringinalism in ways that deprived Democrats of traction to oppose Justice Gorsuch's appointment to the Supreme Court.
