Federalism as a Path for Marijuana Legalization: The STATES Act

Recently Senators Corey Gardner (R-CO) and Elizabeth Warren (D-MA) introduced the STATES Act, which amends the provisions of the Controlled Substances Act governing marijuana to whatever a state's marijuana laws might be. Professor Randy Barnett consulted with Senator Gardner and his staff on this two-page bill, assisted in its drafting, and defended the idea in a Wall Street Journal op-ed. In this lunch talk, he will explain why this compromise between the current federal ban and complete legalization could chart a landmark course to increased reliance on federalism to address our most contentious economic and social policies.
