Election Regulation & Justiciability: Political Question Doctrine, Gerrymandering & Restrictive Voting Laws

The pandemic has impacted many things including democracy. Political actors have filed numerous suits over election related regulations. The proponents of these requirements argue the rules preserve the integrity of elections. The opponents cry voter suppression and argue the technical requirements are veiled attempts to disenfranchise certain voting blocks. However, in some situations the courts have declined jurisdiction over these "political" disputes. Prof. Muller will discuss some the policy justifications behind the political question doctrine and discuss its application to current events.
