The body of federal criminal law has expanded substantially since 1970, and now substantially overlaps state criminal law in many aspects of “street crime,” such as gun violence and drugs. This overlap can result in intentional, and unintentional, disparities in federal and state treatment of the same conduct, and it raises questions of federalism given the American traditions of state primacy over criminal law, as well as forum-shopping. Professor John Stinneford will trace the development of this growth of substantive federal law, discuss the potential concerns the overlap between federal and state criminal law can create, and explain how these concerns intersect with federal constitutional principles of federalism and subsidiarity.
