Description

Chevron v. NRDC (1984) and subsequent precedents held that courts should defer to reasonable agency interpretations of ambiguous statutes. This “Chevron Deference” has ruled the legal and administrative landscape for decades. In two cases this term (Loper Bright Enterprises v. Raimondo and Relentless Inc. v. Department of Commerce), the Court considered challenges to that precedent and on June 28, 2024, a 6-3 Court issued its decision overturning Chevron.

What will the overturning of Chevron mean for business, and for in-house counsels across the country and world? How will administrative agencies adapt now that Chevron is on the ash heap of history? How will the Court’s new cases be interpreted and applied by the lower courts?

Description

For decades, as federal and state agencies grew, and the scope of their authority expanded, businesses seemed inclined to simply comply with newly imposed requirements, even sometimes beginning compliance efforts before proposed rules were finalized. More recently, in-house counsels are increasingly challenging government agency actions in court. Is this new phenomenon here to stay? Does it represent a change in attitude in certain businesses, or does it stem from a perception of excessive government power? What are the factors used by businesses when calculating when to challenge and when to comply? This panel will provide practical examples of how and when such challenges have succeeded and fallen short.
