Written well over a hundred years ago, Article I, Section 19 of the Texas Constitution commands that individuals cannot be deprived of “life, liberty, property, privileges or immunities, or in any manner disfranchised, except by the due course of the law of the land.” But what does this clause protect, and how does it do so? Arif Panju of the Institute for Justice joins us to discuss what the historical sources reveal about the ancient right to pursue a livelihood, the original public meaning of “liberty” and “privileges or immunities” in 1876, and why Texas’s “law of the land” clause guarantees meaningful judicial review.
