In this talk, Prof. Eric Claeys of the George Mason University School of Law will explain why legal property rights are weaker than informal customs and moral opinions about property. Using John Locke’s property theory, Claeys explains how people judge formal laws and government by how well those institutions secure to citizens the fruits of their labor. Claeys illustrates with case studies about land squatters and miners’ customs in the nineteenth century, contemporary “snow dibs” customs about winter parking spaces, and contemporary customs about surfing rights on Pacific beaches.
