This panel will examine strategic decision-making in complex litigation and the practical considerations that shape the trajectory of high-stakes disputes. Designed with young lawyers in mind, the discussion will focus on how litigators evaluate key procedural and substantive issues at the outset of a case, including jurisdictional questions, pleading strategy, discovery considerations, and appellate preservation.


Panelists will explore how evolving doctrines in standing, preemption, administrative law, and civil procedure influence litigation strategy across a variety of forums. The conversation will highlight the factors practitioners weigh when determining where and how to bring claims, respond to challenges, and position cases for long-term success.


In addition, the panel will address the realities of litigating in multiple forums, including jurisdictional disputes, removal and remand practice, parallel proceedings, and the strategic considerations that arise when cases present both state and federal law issues. Particular attention will be given to the role junior attorneys play in these efforts—from early case assessment and legal research to drafting motions and developing case strategy.


Finally, panelists will consider how litigation strategy intersects with broader questions about the judicial system, federalism, and the development of legal doctrine. The discussion will provide attendees with both practical tools for modern litigation practice and a deeper understanding of how strategic decisions can influence the evolution of the law.
