Cancel Culture Meets the Regulatory State: The Case of Debanking and Financial Services

The Obama Administration launched "Operation Choke Point," an multi-agency initiative that targeted certain lawful industries by denying them banking services, including industries engaged in constitutionally-protected actions. In recent years there have been increasing cases of individuals and organizations being debanked, apparently for holding politically controversial opinions, including religious liberties organizations and others. In addition, there has been growing pressure by financial regulators, progressive activist groups, and Woke corporate leaders to leverage the financial system against fossil fuel and other similar industries. More recent, similar efforts have been used by government officials to censor speech on by social media platforms, as illustrated by the "Twitterfiles" and the case of Missouri v. Biden. 

Professor Todd J. Zywicki, George Mason University Foundation Professor of Law at Antonin Scalia Law School and Visiting Scholar in Conservative Thought and Policy at the University of Colorado-Boulder, Bruce Benson Center for the Study of Western Civilization will discuss the growing threat of the regulatory state is being used to circumvent democratic processes and infringe on constitutionally-protected rights and proposals for how to address the threat.
