California recently empowered the state medical board to investigate and discipline doctors who share information that the state deems to be medical "misinformation" or "disinformation" as it concerns Covid and Covid vaccines. What does it mean? Who decides what counts as medical "misinformation" or "disinformation"? How quickly can a standard of medical care emerge about a novel virus – and an even more novel vaccine – and how much may the state levy its police power to enforce it?

(Quick anecdote about the "standard of care" and "misinformation": At the time of President James Garfield's death, Joseph Lister's germ theory, not yet accepted by the medical community, was considered what we now might call "misinformation." And so President Garfield, his doctor having repeatedly plunged dirty fingers into his wound searching for Charles Guiteau's bullet – fully consistent with the standard of care – died of sepsis.)
