Administrative Agencies 101: How Do Agencies Resolve Disputes?

Executive agencies have the power to investigate violations of law within their purview and adjudicate them in-house. In the past, the Supreme Court has upheld the right of agencies to develop new regulatory standards through their own in-house adjudication process.  But what gives them such authority? Are the rule of law and separation of powers compatible with agency policy making via in-house adjudication?

Paul Ray, Boris Bershteyn, and Roger Nober — administrative law experts with first-hand experience in administrative adjudications and policy making — will debate and discuss this consequential topic. Jane Luxton, the former General Counsel of the National Oceanic and Atmospheric Administration, will moderate the discussion.

Featuring:

  • Boris Bershteyn, Partner, Skadden, Arps, Slate, Meagher and Flom, LLP and Affiliates
