For some businesses, California may have relinquished its title as the Golden State, with high taxes, heavy regulation, and steep prices. As the business climate grows more difficult, some businesses are pulling up stakes and moving elsewhere. Others remain, taking advantage of the state's vast resources and workforce. This panel explores the reasons behind these corporate decisions and discusses whether the relocation trend will continue. Is this shift temporary, perhaps driven by employee relocation during the pandemic, as quality-of-life factors took on new importance? Are other states better corporate environments? What business advantages does California continue to offer? Should any corporation decide to set up in California today? What opportunities or avenues might business pursue to reclaim a favorable corporate climate?

The cost and compliance burden of California’s taxes, regulations, and legal environment are significant. The American Tort Reform Foundation regularly labels California a “legal hellhole,” detailing widespread lawsuit abuse against business. Uniquely burdensome state laws such as the Private Attorneys General Act and the California Consumer Protection Act provide fodder for lawsuits and arguably wipe out millions of dollars of economic activity. Small businesses are regularly confronted with Americans with Disability Act litigation, which California’s Unruh Act makes more lucrative for plaintiffs. And a wide range of employers face weighty labor liability and costs, from worker classification to wage-and-hour litigation. Beyond the legal landscape, California is one of the most highly regulated states, with permitting, licensing, and administrative requirements. And it has urged businesses into corporate social activism, mandating board diversity quotas and climate disclosures. This panel addresses some of these legislative, regulatory, and legal challenges for businesses still in California.
