Description

This panel seeks to explore the current state of First Amendment law and how it interacts with the media’s coverage of elected officials and public figures. There have been increasing calls for the Supreme Court to revisit its New York Times v. Sullivan decision and rein in the actual malice standard applied to public figure plaintiffs. Where is the law now, and where is it heading? Our panelists, First Amendment litigators, will discuss the current state of defamation law in our courts, and where the line is drawn between the free flow of ideas while still allowing individuals recourse to protect themselves from false accusations.

The Wisconsin REINS Act likely slowed the creation of new regulations in Wisconsin. As the federal government and other states consider their own versions of REINS, what lessons are there to be learned from Wisconsin? What could a national version of the REINS Act look like, and will Trump's Administration implement such a measure? What are other states looking to implement, and how could Wisconsin improve its version of REINS?
