Description

In recent years, the Supreme Court has decided critically important executive power and administrative law cases involving efforts to expand presidential power through presidential immunity and administrative agencies. But due to the policy priorities of the new administration, it seems that the next wave of executive power and administrative law cases will center on the president’s authority to seek to diminish presidential power by limiting the size of the federal government and cutting governmental workers and spending. Does Article II vest the President with the discretion to cut government spending and rollback civil service protections, such as in the various ways being recommended by the Department of Government Efficiency (DOGE)? And how will Article II cases during the next four years compare to the Article II cases of the Clinton, Bush, Obama and Biden administrations? This Panel will examine both recent and current challenges to the powers of the Presidency and what those challenges all mean for the future of the Presidency. The Panel will also discuss the practical hurdles that the administration will face to the extent that it tries to get Congress to approve spending cuts and federal jobs and department eliminations.

Judicial nominations are one of the longest lasting legacies as a president. What qualities will President Trump consider in his second term appointments? Will his standards mirror those from his first term, or will he value other qualities? How will examples of “courage” in legal practice and on the bench be valued? How will district court nominees be considered in states with senators from different parties, like Pennsylvania?
