Fisher v. University of Texas comes before the Court just as an unprecedented number of scholars have published work directly or indirectly calling into question some of the basic assumptions of affirmative action policies. Is the Supreme Court poised to make more fundamental changes to affirmative action in higher education than it did in either Bakke (1978) or Grutter and Gratz (2003)? Does Fisher have the markings of a landmark U.S. Supreme Court case?
