Southern Union Company v. United States - Post-Argument SCOTUScast

On March 19, 2012 the Supreme Court heard oral argument in Southern Union Company v. United States. The question in this case is whether the imposition of criminal fines is subject to the Fifth and Sixth Amendment principles articulated in Apprendi v. New Jersey, which holds that “[o]ther than the fact of a prior conviction, any fact that increases the penalty for a crime beyond the prescribed statutory maximum must be submitted to a jury, and proved beyond a reasonable doubt.”
