On Monday, June 29, the Supreme Court announced its decision in Ricci v. DeStefano. In this case, the Supreme Court considered whether the City of New Haven committed racial discrimination in violation of the Equal Protection Clause or Title VII by rejecting the results of an otherwise valid civil service exam because of the racial distribution of the results. In a 5-4 decision delivered by Justice Kennedy, the Court held that the City had violated Title VII and that the firefighters were entitled to summary judgment on their claim, reversing the Second Circuit decision below. Michael Rosman, General Counsel for the Center for Individual Rights, discusses the decision.
