In his final State of the Union speech on Tuesday, President Obama joked that he still had “plenty” of policy proposals and promised he would “not let up until they get done.” But notably missing from the speech were the calls to Congress to “send me a bill… give me authority” that had resonated in previous speeches. Instead, the President likely intends to continue to pursue his policy goals unilaterally, and regulation is one of the most powerful tools at his disposal to do that.

More than any other president in history, President Obama has used regulation as an instrument to reshape policy, and his agencies have aggressively issued sweeping new rules to advance his goals. All signs suggest that the next 12 months will be even more ambitious.
