Ben Flowers, a partner at Ashbrook Byrne Kresge Flowers LLC, is an accomplished litigator with experience briefing, arguing, and winning high-stakes cases in courts throughout the country.
Before joining the law firm, Ben served as Ohio's 10th Solicitor General. In that role he regularly represented the State of Ohio before the Supreme Court of the United States, the United States Court of Appeals for the Sixth Circuit, and the Supreme Court of Ohio. Most prominently, in National Federation of Independent Business v. Department of Labor, Ben led a multi-state challenge to OSHA's vaccine mandate, ultimately prevailing before the Supreme Court.
Ben is a graduate of The Ohio State University and the University of Chicago Law School. Following law school, Ben clerked for Judge Sandra Ikuta of the U.S. Court of Appeals for the Ninth Circuit and for Justice Antonin Scalia of the Supreme Court of this United States. Ben lives in Upper Arlington, Ohio with his wife Denise and their three very active children.

Judge Nelson was confirmed to the Ninth Circuit in October 2018, as the youngest Circuit Judge to serve from Idaho and he has chambers in his hometown of Idaho Falls. Prior to his confirmation, Judge Nelson served for nine years as General Counsel of Idaho Falls-based Melaleuca, Inc., a consumer goods company. He previously worked in Washington, DC, where he served in all three branches of the federal government, including as Special Counsel for Supreme Court nominations to the Ranking Member of the Senate Judiciary Committee; Deputy General Counsel to the White House Office of Management and Budget; Deputy Assistant Attorney General in the Environment and Natural Resources Division of the United States Department of Justice; and a law clerk to Judge Henderson of the United States Court of Appeals for the D.C. Circuit. He has argued in most of the federal courts of appeals and worked on dozens of Supreme Court briefs. He started in the Washington, DC office of Sidley Austin as an appellate lawyer, after clerking for Judges Mosk and Brower of the Iran-U.S. Claims Tribunal at The Hague, and for now-Judge Tom Griffith, then-Senate Legal Counsel, during the impeachment trial of President Clinton. Judge Nelson earned his B.A. from Brigham Young University and his J.D., with honors, from BYU Law School. Judge Nelson has been a member of the Federalist Society since 1998.

Judge Tung was nominated for the judgeship on July 15, 2025, and had his hearing before the U.S. Senate Judiciary Committee on July 30. His nomination was reported to the Senate floor on September 11.
Tung has been a partner at Jones Day in Los Angeles. He has clerked twice on the U.S. Supreme Court—for the Honorable Neil M. Gorsuch during October Term 2017 and for the Honorable Antonin G. Scalia during October Term 2012. Tung also served in the U.S. Department of Justice in several different roles: as counsel in the Office of Legal Policy in 2017, during which time he received the Attorney General’s Distinguished Service Award; as an assistant U.S. attorney in the Office of the U.S. Attorney for the Central District of California from 2016 to 2017; and as a Bristow Fellow in the Office of the Solicitor General from 2011 to 2012. Prior to his service in the executive branch, Tung was an attorney at Munger, Tolles & Olson LLP in Los Angeles, from 2014 to 2016, and clerked for then-Judge Gorsuch, of the U.S. Court of Appeals for the 10th Circuit, from 2010 to 2011.
Tung graduated with a Bachelor of Arts from Yale University in 2006 and earned his Juris Doctor, with high honors and Order of the Coif, in 2010 from The University of Chicago Law School, where he was managing editor of the Law Review
