Description

The proper nature and practice of originalism at the federal level is far from a settled subject. But with respect to the U.S. Constitution, the sources feeding into that lively debate have never been more available or extensive. The arguments for applying originalist and textualist interpretation to state constitutions and statutes are just as strong, but the resources are often rarer and more opaque. The panelists, drawing on experience in both state and federal litigation, will describe the contours and challenges of "doing originalism" at the state level.
