Please join the Vermont Lawyers Chapter for a virtual conversation with Tim Keller on school choice, Espinoza v. Montana Department of Revenue, and its implications for education reform in Vermont. In Espinoza, the U.S. Supreme Court is considering whether the Free Exercise Clause permits a state supreme court may strike down a school choice program, in its entirety, as violating a state constitution's Blaine Amendment because the program permits parents to choose religious schools. If, as expected, the U.S. Supreme Court holds that states may not discriminate against religious schools or exclude them from otherwise neutral educational choice programs, what are the implications for programs like Vermont's and Maine's town tuitioning programs? What role, if any, does the anti-Catholic animus that originally fueled the Blaine movement play today? Tim is also willing to share his thoughts on what impact COVID-19, the current school shutdowns, and the looming budget concerns may have on education.
