The October 2023 term at the U.S. Supreme Court may bring fundamental changes to administrative law, and by extension the way the federal government works, as the Court’s decisions in recent years demonstrate its increasing skepticism of government power. The case with the potential broadest implications is Loper Bright Enterprises v. Raimondo in which the Court is considering whether to overrule Chevron. The Court is also reviewing the constitutionality of both the Consumer Financial Protection Bureau’s funding structure in CFPB v. Community Financial Services Association of America and the Securities and Exchange Commission’s in-house adjudicative proceedings in SEC v. Jarkesy. These cases follow the rise of the major questions doctrine (West Virginia v. EPA (2022)), the reinvigoration of the nondelegation doctrine (Gundy v. United States (2019)), and new procedural avenues for pre-enforcement challenges to agencies’ proceedings (Axon Enterprise, Inc. v. FTC (2023)). The appellate courts have similarly relied on this trend to restrain the administrative state, including constitutional challenges to the structure of self-regulatory organizations that wield enforcement powers under the Appointments and Non-delegation clauses (Alpine Sec. vs. Financial Industry Regulatory Authority (D.C. Cir. 2023)). New limits on agency power, coupled with novel procedural avenues for questioning agency proceedings, create fresh opportunities for businesses to challenge unfavorable regulations. At the same time, however, an increasing willingness to curtail agency authority might destabilize long-standing rules that businesses rely upon. Practically speaking, how should in-house counsel think about this transformation of administrative law? What challenges and opportunities lie ahead for businesses?
