On April 15th, the DC Circuit upheld EPA’s regulation of mercury and air toxics from coal- and oil-fired power plants. Then, on April 29, the Supreme Court reversed the DC Circuit's decision striking down EPA’s regulation of cross-state, upwind air emissions. The panel members will discuss these cases and how they affect EPA’s plans to regulate carbon emissions from power plants as part of President Obama’s Climate Action Plan.
