Regulatory Influence and Federal Independent Contractor Rulemaking

Much criticism has been levied against the administrative state for burdening businesses and restricting consumer options.  But as much as the regulatory state needs reform, lawyers and the regulated community should still focus significant energy on influencing the regulations that come out of those agencies, including the positive regulations they or their clients/members support.  This discussion will address the current state of the administrative state; extol the virtues of participation in the regulatory process; and identify key ways to influence regulations, all through the lens of the US Department of Labor’s efforts to expand (in 2020-21) and restrict (in 2021-present) independent contracting via regulation.
