Description

This distinguished panel of leading jurists — who serve on the bench at various state and federal levels—will discuss the importance of judicial independence through the lens of recent attacks on the judiciary.  Topics we will explore include (1) an uptick in security concerns and threats to judges and court personnel; (2) increasingly personal attacks on judges—rather than judicial decisions—in the media; (3) incidents of hostility to judges on law school campuses and in other public settings; (4) the response (or lack of response) from traditional defenders of the courts.

Panelists will discuss the law of war with particular attention on the Israeli-Hamas conflict in Gaza. The speakers will consider ethics and the rule of law in armed conflict, including preventing and countering threats to civilian society, violations of human rights and the rule of law, and prosecuting war crimes. They will consider the plight of civilians, following orders, the ethics of armed conflict, and the role cultural differences play in interpreting the laws of war.

How do we safeguard and restore the rule of law? What is the Prosecutor’s role in establishing the Rule of Law? Do Prosecutors need more legislation to fulfill this role? Should they be innovative in their use of prosecutorial discretion? How can they maintain and/or restore public confidence in the criminal justice system? Is ‘truth in sentencing’ legislation part of the solution? Our panelists will offer varied perspectives.
