Cutting edge executive and legislative solutions. This panel will discuss the many inventive legislative and executive solutions to policy problems that have originated in the states. Texas has been an important center of such activity in recent years. The panel will discuss the federalism problems these solutions sometimes create when they go against federal policy choices. The panel may also suggest new frontiers for this emerging trend and offer predictions about future legislation.

Cutting edge litigation solutions. This panel will discuss the rise of the so-called “conservative plaintiff’s bar.” In recent years, we’ve seen more conservative litigation boutiques pop up and carefully orchestrate successful legal challenges to various laws or precedents that are inconsistent with the Constitution and our division of government. To that end, we’ve also seen a rise in public interest groups focusing on specific causes, filing amicus briefs, and partnering with Big Law to do the same. So too with the importance of State SGs becoming the people’s lawyers. From Affirmative Action/DEI programs (litigation boutiques), to religious liberty (public interest and Big Law), to gender identity laws (state Solicitors General ), the panel can explore how we got to where we are and where we are going.
