Panel 1: The Rights Guaranteed by the Tennessee Constitution

Description

The Tennessee Constitution, unlike the United States’, guarantees rights to victims of crime and to alter government in any manner (indeed, it insists that “nonresistance against arbitrary power and oppression is absurd, slavish”). At the same time, it specifically empowers the legislature to “regulate the wearing of arms with a view to prevent crime,” has been interpreted to convey economic rights, and obligates the legislature to provide “a system of free public schools.” What does this practically mean for the freedom of Tennesseans?

Featuring:

  • Braden Boucek, Director of Litigation, Southeastern Legal Foundation
  • Charlotte Davis, Attorney, Harpeth Estate Law
  • Hon. Tom Greenholtz, Judge, Tennessee Court of Criminal Appeals
  • Hon. Stephen Vaden, Judge U.S. Court of International Trade
  • Moderator: Hon. Jeff Bivins, Tennessee Supreme Court

Description

An attorney general selected by the Supreme Court, a legislature that approves regulations but not Cabinet officials, county home rule - these are just some of the features that distinguish the Tennessee Constitution’s vision for government from the United States’. How did our state framers think differently in limiting our government and have they been successful?

Featuring:

  • Hon. Bob Cooper, Member, Bass, Berry & Sims and Former Attorney General, Tennessee
  • Matt Rice, Associate Solicitor General, Office of Tennessee Attorney General
  • Hon. John Stevens, Tennessee State Senate, District 24
  • Hon. Jeff Usman, Judge, Tennessee Court of Appeals
